According to the Associated Press and the New York Times, the Lawyers for Activision told court officials that they had finally come to a settlement with Double Fine Studios on Wednesday.

The Los Angeles Superior Court spokeswoman said that Activision settled with Double Fine and a hearing, that was supposed to occur this fine Thursday morning, was canceled. What was heard last week was that the Superior Court Judge Craig Karlan had told Activision's lawyers that the request was probably going to get denied and the game was going to get released on time anyways.

On the flip side of things though, this whole thing hasn't hindered EA's plans at all. In fact, just this morning they announced a new contest for the game that they are doing. A pretty awesome one if I do say so myself. In fact, it is a way to get one of those Eddie statues they teased off their twitter account just before Comic Con this year. Although the custom guitar based on one from the game is the actual big prize to be had. All you need to do is fill out a form and probably deal with a little IGN spam.
